This website and all associated services are operated by Creadaptic Volleyball Club Inc. (hereinafter referred to as "CVC", "we", "us", or "our").
By accessing our website, purchasing a membership, registering for trials, or engaging with our digital platforms (including "The Lab", "Match Centre", and "Official Store"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users, including browsers, vendors, customers, athletes, and contributors of content.
If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.
These Terms constitute the entire agreement between you and CVC and supersede any prior agreements. In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed to be severed from these Terms.
We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically for changes. Your continued use of the website following the posting of any changes constitutes acceptance of those changes.
By joining CVC or participating in our programs, you acknowledge that CVC operates as a high-performance sporting organisation. You understand and agree that:
Training Demands: Our programs involve rigorous training schedules, high-intensity physical conditioning, and performance requirements as determined by CVC coaching staff. You accept the physical demands and risks associated with elite-level sport protocols.
Assumption of Risk: Participation in volleyball and associated strength and conditioning activities carries inherent risks of physical injury or death. You voluntarily assume full responsibility for these risks and release CVC and its affiliates, venue providers, and partners from liability.
Selection & Progression: Team selection, court time, and squad placement are at the sole discretion of the coaching staff. Payment of fees does not guarantee selection, starting positions, or specific playing time.
Fees & Non-Refundability: All membership fees, trial fees, and related costs are non-refundable unless otherwise required by Australian Consumer Law.
Commitment: Acceptance of a position constitutes a financial commitment for the full season or program duration. Withdrawal does not void your obligation to pay any outstanding fees.
Discretionary Refunds: CVC may, at its absolute and sole discretion, consider requests for pro-rata refunds or credits in exceptional circumstances (such as severe medical incapacitation or forced relocation). Such requests must be supported by verifiable documentation satisfactory to CVC. All determinations by CVC regarding refunds are final.
Vouchers: Government sport vouchers must be presented in accordance with our administrative timelines to be valid.
We utilise various technologies to monitor athlete performance and club operations. By participating, you consent to:
Performance Data: The collection, analysis, and internal or public display of performance statistics, match data, and related metrics.
Health & Biometrics: The collection of physiological and health-related data via wearable technology or other assessment tools for the purposes of load management, injury prevention, and performance optimisation.
Media & Analysis: The recording of training and match footage for tactical analysis, coaching, and promotional purposes.
You grant CVC an irrevocable, worldwide, royalty-free license to use your image, likeness, voice, and name in any media formats now known or hereafter developed, including for marketing, social media, and commercial purposes.
High-resolution match photos may be published publicly. If you have a specific safety or legal reason (e.g., Witness Protection, Domestic Violence Safety Orders) requiring your image to be suppressed, you must notify CVC in writing immediately upon joining.
We value your feedback and innovation. If you send us creative ideas, suggestions, proposals, plans, or other materials (collectively, "Submissions") via "The Lab" or whether online, by email, or otherwise, you agree that CVC may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any Submissions that you forward to us.
We are and shall be under no obligation:
(1) to maintain any Submissions in confidence;
(2) to pay compensation for any Submissions; or
(3) to respond to any Submissions.
By submitting, you grant CVC a perpetual, irrevocable, worldwide, royalty-free license to commercialise your suggestions.
The CVC "Phoenix" logo and "Creadaptic" brand are proprietary. You may not use our branding for personal gain or unauthorised merchandise without written permission.
Availability: Products on the Official Store (training kits, equipment) are subject to stock availability. We reserve the right to limit quantities or discontinue products at any time.
Errors & Omissions: Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, and availability. We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate at any time without prior notice.
Pre-Orders: These are often made-to-order. Delivery timelines provided are estimates only.
Returns: We accept returns for defective goods in accordance with Australian Consumer Law. We do not offer refunds for "change of mind", particularly on customised team wear.
We reserve the right to terminate or suspend your membership or access to our services at any time, without notice, for conduct that we, in our sole judgment, believe violates any applicable law, is harmful to our interests, or breaches our standards. This includes, but is not limited to, harassment, abuse, disparagement of the Club, or bringing the sport into disrepute.
Our services may integrate with or utilise third-party providers for facilities, software, data processing, and health services. We are not liable for the acts, omissions, or operational failures of these third parties. Your use of third-party services may be subject to their respective terms and policies.
In addition to other prohibitions, you are prohibited from using the site or its content:
(1) for any unlawful purpose;
(2) to solicit others to perform or participate in any unlawful acts;
(3) to submit false or misleading information;
(4) to upload or transmit viruses, worms, or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service;
(5) to collect or track the personal information of others (including scraping member data);
(6) to interfere with or circumvent the security features of the Service.
We reserve the right to terminate your use of the Service for violating any of the prohibited uses.
To the fullest extent permitted by law, CVC and its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use of our services, participation in our programs, or any interactions with the Club, however caused.
You agree to indemnify, defend, and hold harmless CVC and our affiliates, partners, officers, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third-party.
CVC shall not be liable for any failure or delay in performing its obligations where such failure or delay results from any cause that is beyond our reasonable control.
This includes, but is not limited to: power outages, internet service provider failures, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action, or public health emergencies (including pandemics and associated lockdowns).
In such events, CVC reserves the right to suspend services or offer alternative delivery methods (e.g., remote programming) in lieu of refunds.
These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Queensland.
